Wir stellen Ihnen diese Datenschutzerklärung zur Verfügung, um Sie darüber zu informieren, wie wir mit Ihren personenbezogenen Daten umgehen, die im Rahmen des Bewerbungsverfahrens erhoben und verarbeitet werden. Sie gilt ausschliesslich für Daten, die im Zusammenhang mit Ihrer Bewerbung bei uns erhoben werden.

Zweck der Datenbearbeitung

Die Bearbeitung Ihrer personenbezogenen Daten erfolgt auf Grundlage von Art. 31 Abs. 1 und 2 revDSG. Mit dem Absenden einer Bewerbung bekunden Sie Ihr Interesse, eine Beschäftigung bei uns aufnehmen zu wollen. Sie übermitteln uns in diesem Zusammenhang personenbezogene Daten. Wir bearbeiten diese ausschliesslich

  • zum Zweck der Durchführung des Bewerbungsverfahrens, insbesondere zur Prüfung Ihrer Erfahrungen,

  • Kommunikation im Rahmen des Auswahlprozesses,

  • Organisation von Bewerbungsgesprächen sowie zur

  • Durchführung vorvertraglicher Massnahmen.

Insbesondere werden dabei die folgenden Daten erhoben:

  • Stammdaten (Vor- und Nachname, Adresse, Geburtsdatum)

  • Bewerbungsunterlagen (Lebenslauf, Zeugnisse, Motivationsschreiben)

  • Kommunikationsdaten (E-Mail-Adresse, Telefonnummer, E-Mail-Verkehr, Interviewnotizen)

Speicherung und Löschung

Ihre Daten werden bis zu 365 Tage nach Abschluss des Bewerbungsverfahrens gespeichert. Dies erfolgt zur Erfüllung rechtlicher Verpflichtungen oder zur Abwehr von etwaigen Rechtsansprüchen. Anschliessend sind wir verpflichtet, Ihre Daten zu löschen bzw. zu anonymisieren. In anonymisierter Form stehen sie uns nur noch als Metadaten ohne direkten Personenbezug für statistische Auswertungen (beispielsweise Frauen- bzw. Männeranteil an Bewerbungen, Anzahl an Bewerbungen pro Zeitraum etc.) zur Verfügung. Sofern Sie im Rahmen des Bewerbungsverfahrens ein Angebot für ein Arbeitsverhältnis bei uns erhalten und dieses annehmen, speichern wir die erhobenen personenbezogenen Daten mindestens für die Dauer des Angestelltenverhältnisses.

Darüber hinaus besteht die Möglichkeit, Ihre Daten mit Ihrer ausdrücklichen Einwilligung in unseren Talent Pool aufzunehmen, um Sie für zukünftige Stellenangebote zu berücksichtigen.

Weitergabe der Daten an Dritte

Auf Ihre Daten haben nur autorisierte Mitarbeitende aus dem Personalbereich bzw. in das Bewerbungsverfahren involvierte Mitarbeitende Zugriff. Die im Rahmen Ihrer Bewerbung übermittelten Daten werden per TLS-Verschlüsselung übertragen und in einer Datenbank gespeichert. Diese Datenbank wird von der Personio GmbH, welche eine Personalverwaltungs- und Bewerbermanagement-Software anbietet (https://www.personio.de/impressum/), betrieben. Personio ist in diesem Zusammenhang unser Auftragsverarbeiter nach Artikel 9 revDSG. Die Grundlage für die Verarbeitung ist ein Auftragsverarbeitungsvertrag zwischen uns als verantwortliche Stelle und Personio. Ihre personenbezogenen Daten werden ausschliesslich in der Schweiz oder im EU-/EWR-Raum verarbeitet. Eine Übermittlung in Drittstaaten findet nicht statt.


Betroffenenrechte

Sie haben gemäss revDSG insbesondere folgende Rechte, die Sie jederzeit und kostenlos ausüben können:

  • Auskunft: Sie können Auskunft darüber verlangen, ob und welche Daten wir über Sie bearbeiten.

  • Berichtigung: Sie können die Berichtigung unrichtiger oder unvollständiger Daten verlangen.

  • Löschung: Sie können die Löschung Ihrer Daten verlangen, sofern keine gesetzlichen Pflichten entgegenstehen.

  • Widerruf: Sie können eine erteilte Einwilligung jederzeit mit Wirkung für die Zukunft widerrufen.

  • Datenherausgabe: Sie können die Herausgabe der von uns gespeicherten personenbezogenen Daten in einem gängigen elektronischen Format verlangen.

  • Beschwerderecht: Sie haben das Recht, sich bei der zuständigen Datenschutzaufsichtsbehörde zu beschweren, wenn Sie der Ansicht sind, dass Ihre personenbezogenen Daten unrechtmässig bearbeitet werden.

Aktualisierung der Datenschutzerklärung

Wir behalten uns vor, diese Datenschutzerklärung jederzeit anzupassen, damit sie stets den aktuellen rechtlichen Anforderungen entspricht oder um Änderungen des Bewerbungsverfahrens oder Ähnlichem abzubilden. Für einen erneuten Besuch dieser Recruiting-Seite oder eine erneute Bewerbung gilt dann die neue Datenschutzerklärung.

We provide you with this privacy notice to inform you about how we handle your personal data collected and processed in the course of the application process. This notice applies exclusively to data collected in connection with your application with us.

Purpose of data processing

We process your personal data based on Article 31(1) and (2) of the revised Swiss Federal Act on Data Protection (revFADP). By applying, you express your interest in taking up employment with us and, in this context, you provide us with personal data. We process this data solely for the purpose of carrying out the application process, to review your experience, communicate during the selection process, organize interviews, and carry out pre-contractual measures.

In particular, the following data is collected:

  • Master data (first and last name, address, date of birth)

  • Application documents (CV, certificates/references, cover letter/motivation letter)

  • Communication data (email address, phone number, email correspondence, interview notes)

Storage and deletion

Your data will be stored for up to 365 days after completion of the application process. This is done to comply with legal obligations or to defend against potential legal claims. After that, we are required to delete or anonymize your data. In anonymized form, it is available to us only as metadata without direct personal reference for statistical evaluations (e.g., share of female vs. male applicants, number of applications per period, etc.).

If you receive an offer of employment from us as part of the application process and accept it, we will store the personal data collected for at least the duration of the employment relationship.

In addition, with your explicit consent, we may include your data in our talent pool to consider you for future job opportunities.

Disclosure of data to third parties

Only authorized employees in the HR department and employees involved in the application process have access to your data. The data transmitted as part of your application is transferred using TLS encryption and stored in a database.

This database is operated by Personio GmbH, which provides HR administration and applicant management software (https://www.personio.de/impressum/). In this context, Personio acts as our processor pursuant to Article 9 revFADP. The processing is based on a data processing agreement between us and Personio.

Your personal data is processed exclusively in Switzerland or within the EU/EEA. No transfer to third countries takes place.

Data subject rights

Under the revFADP, you have the following rights, which you may exercise at any time and free of charge:

  • Right of access: You may request information on whether and which data we process about you.
  • Right to rectification: You may request the correction of inaccurate or incomplete data.
  • Right to erasure: You may request deletion of your data, provided no statutory obligations prevent this.
  • Right to withdraw consent: You may withdraw any consent you have given at any time with effect for the future.
  • Right to data release: You may request that we provide the personal data stored about you in a commonly used electronic format.
  • Right to lodge a complaint: You have the right to lodge a complaint with the competent data protection supervisory authority if you believe your personal data is being processed unlawfully.

Processing of (personal) data by the operator of the recruitment website

General information

This recruitment website is operated by Personio SE & Co. KG, which offers a human resource and candidate management software solution (https://www.personio.com/legal-notice/). Data transmitted as part of your application will be transferred using TLS encryption and stored in a database. The sole controller of this data within the meaning of article 24 of the GDPR is the enterprise carrying out this online application process. Personio’s role is limited to operating the software and this recruitment website and, in this context, being a processor under article 28 of the GDPR. In this case, the processing by Personio is based on an agreement for the processing of orders between the controller and Personio. In addition, Personio SE & Co. KG processes further data, some of which may be personal data, to provide its services, in particular for operating this recruitment website. We will refer to this in more detail below.

Access logs (“server logs”)

Each access to this recruitment website automatically causes general protocol data, so-called server logs, to be collected. As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. Without this data, it would, in some cases, be technically impossible to deliver or display the contents of the software. In addition, processing this data is absolutely necessary under security aspects, in particular for access, input, transfer, and storage control. Furthermore, this anonymous information can be used for statistical purposes and for optimizing services and technology. In addition, the log files can be checked and analyzed retrospectively when unlawful use of the software is suspected. The legal basis for this is §25 subsection 2 Sentence 2 TDDDG. Generally, data such as the domain name of the website, the web browser and web-browser version, the operating system, the IP address, as well as the timestamp of the access to the software is collected. The scope of this log process does not exceed the common log scope of any other site on the web. These access logs are stored for a period of up to 7 days. There is no right to object to this.

Error logs

So-called error logs are generated for the purpose of identifying and fixing bugs. This is absolutely necessary to ensure we can react as quickly as possible to possible problems with displaying and implementing content (legitimate interest). As a rule, this data is a pseudonym and thus does not allow for inferences about the identity of an individual. The legal basis for this is §25 subsection 2 Sentence 2 TDDDG. When an error message occurs, general data such as the domain name of the website, the web browser and web-browser version, the operating system, the IP address, as well as the timestamp upon occurrence of the respective error message and/or specification is collected. These error logs are stored for a period of up to 7 days. There is no right to object to this.

Use of cookies

So-called cookies are used on parts of this recruitment website. They are small text files which are stored on the device with which you access this recruitment website. If the personal data is processed with your consent, you have the right to withdraw this consent under article 7 III of the GDPR. Concluding provisions

Personio reserves the right to adjust this data privacy statement at any point in time to ensure that it is in line with the current legal requirements at all times, or in order to accommodate changes in the services offered, for example when new services are introduced. In this case, the new data privacy statement applies to any later visit of this recruitment website or any later job application.
